An obstacle has been placed in the way of the Labour Party’s ObiDatti23 Forward Ever Rally on Wednesday after a Federal High Court in Lagos ruled that the party and its supporters should not assemble at the Lekki Toll-Gate on October 1, 2022, as had been planned.
The court decided that Labour Party supporters are allowed to access the Toll-Gate for their rally but they are not required to gather at the location.
According to The Punch, Justice Daniel Osiagor, the presiding judge, also gave orders to Lagos State Commissioner of Police Abiodun Alabi and Inspector-General of Police Usman Baba to make sure the order was followed.
The order was issued by Justice Osiagor on Wednesday while making a decision on a Motion for Injunction filed by ten plaintiffs, including nine lawyers.
The judge’s verdict was made on the day that political parties were supposed to launch their nationwide campaigns.
These plaintiffs asked the court to prevent the LP, its presidential candidate Peter Obi, his running mate Yusuf Baba-Ahmed, one Julius Abure, and their supporters from holding the rally, among other things.
The plaintiffs claimed that the gathering could lead to a breakdown in law and order and a recurrence of the incident that occurred on October 20, 2020, when soldiers fired on Nigerians who were protesting peacefully at the toll gate.
Due to a lack of jurisdiction, the defendants filed a notice of preliminary objection to prevent the court from considering the motion.
In order to give the parties to the lawsuit time to be served, the court decided to set November 4 as the new date for further hearing.
